ORaaS Terms of Service

The following terms and conditions govern all use of the ORaaS website and all content, services and products available at or through the website, including, but not limited to and when available, ORaaS Forum Software (taken together, the Website). The Website is owned and operated by CS GROUP (herinafter "CS"). The Website is offered subject to your acceptance without modification of all of the terms and conditions contained herein and all other operating rules, policies (including, without limitation, Orekit’s Privacy Policy and Community Guidelines) and procedures that may be published from time to time on this Site by CS (collectively, the “Agreement”).
Please read this Agreement carefully before accessing or using the Website. By accessing or using any part of the web site, you agree to become bound by the terms and conditions of this Agreement. If you do not agree to all the terms and conditions of this Agreement, then you may not access the Website or use any services.

ORaaS is free. Therefore, CS expects from users of its service to use it in a reasonable manner. All demos, services and tools are provided as-is, although CS is engaged to maintain them as reliable as possible.

ORaaS services demos provide examples of how the ORaaS REST API may be used. They are provided as-is, and CS should not be kept responsible for potential bugs.

ORaaS tools are small but useful widgets which aim at easing some daily calculations made by space engineers. They are provided as-is, and CS should not be kept responsible for potential bugs.

ORaaS REST API is the core of this new service encapsulating Orekit. CS has made available a reasonable amount of resources, available free of charge, to users to test ORaaS API, and to check if this service might be interesting to be developed furthermore. CS therefore expects from its users that they use this service in a reasonable manner. Reasonable meaning that computations launched by users should not concern, for example, too long periods of time which would require high level of computation resources.

The meaning of reasonable is at the sole discretion of CS. For example, will be considered as a non-reasonable use, computation launched by users for too long periods of time which would require high level of computation resources. If the Website is not used in a reasonable manner, CS may terminate your access to all or any part of the Website at any time, with or without notice, effective immediately.

CS, ORaaS, the OraaS logo and any trademarks, service marks, graphics, logos and any other intellectual property rights used in connection with the Website are owned by CS or third parties. This Agreement does not imply any transfer of the intellectual property rights owned by CS or third parties. The use of the Website grants you no right to license or reproduce any CS or third parties intellectual property rights.

CS reserves the right, at its sole discretion, to modify or replace any part of this Agreement. It is your responsibility to check this Agreement periodically for changes. Your continued use of or access to the Website following the posting of any changes to this Agreement constitutes acceptance of those changes. CS may also, in the future, offer new services and/or features through the Website (including, the release of new tools and resources). Such new features and/or services shall be subject to the latest version online of the terms and conditions of this Agreement.

CS may terminate your access to all or any part of the Website at any time, with or without cause, with or without notice, effective immediately. If you wish to terminate this Agreement or your ORaaS account (if applicable), you may simply discontinue using the Website. All provisions of this Agreement which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

The Website is provided “as is”. CS and its contractors hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement. Neither CS nor its contractors, makes any warranty that the Website will be error free or that access thereto will be continuous or uninterrupted. If you are actually reading this, here’s a treat. You understand that you download from, or otherwise obtain content or services through, the Website at your own discretion and risk.

In no event will CS, or its contractors, be liable with respect to any subject matter of this Agreement under any applicable legal theory for: (i) any direct and indirect damages the use of the Website may cause to its user; (ii) the cost of procurement for substitute products or services; (iii) any interruption of use, loss or corruption of data; or (iv) any failure or delay of any kind.

You represent and warrant that (i) your use of the Website will be in strict accordance with the CS Privacy Policy, with this Agreement and with all applicable laws and regulations (including without limitation any local laws or regulations in your country, state, city, or other governmental area, regarding online conduct and acceptable content, and including all applicable laws regarding the transmission of technical data exported from the country in which this website resides or the country in which you reside) and (ii) your use of the Website will not infringe or misappropriate the intellectual property rights of any third party.

You agree to indemnify and hold harmless CS, its contractors, and its licensors, and their respective directors, officers, employees and agents from and against any and all claims and expenses, including attorneys’ fees, arising out of your use of the Website, including but not limited to your violation of this Agreement.

This Agreement is governed by the French law.

Any dispute arising out of this Agreement shall be settled amicably. If the matter is not resolved through negotiation, all disputes arising out of this Agreement shall be exclusively decided by the Courts of Nanterre. Notwithstanding the above, a consumer may bring proceedings in the courts for the place of its domicile.
